SUBJECT: Ruling in Federal Court a win for USIS and Trucking Industry
For 25 years, USIS Commercial Services (formerly DAC Services) has provided trucking-industry specific screening solutions, peace of mind

FALLS CHURCH, Va., Sept. 7, 2006 - USIS Commercial Services, formerly known as DAC Services, was found not liable for any wrongdoing or damage in a federal lawsuit filed by the Owner-Operator Independent Drivers Association (OOIDA) and several individual truck drivers. After a short deliberation, the final verdict was delivered Tuesday, Sept. 5, with an eight-person federal jury in Denver, Colo., ruling that USIS's Commercial Services' comprehensive employment history repository for the trucking industry can continue providing its customers with critical information to assist companies in making informed hiring decisions.

"The decision means that the jury believes USIS is fully compliant with Fair Credit Reporting requirements and that the policies and procedures we have in place do not cause harm to drivers," said Kent Ferguson, senior manager for verification products at USIS. "We want our customers to know that this decision means that trucking companies are not considered to be consumer reporting agencies, and that the information they compile and provide to us is not considered a consumer report."

Ferguson emphasized the care that USIS takes with the information and that the serious business of highway safety means that the trucking industry must have the right pre-employment screening information to make informed hiring decisions. "The jury in this case found that USIS is compliant with the Fair Credit Reporting act," said Ferguson. "We take very seriously the needs of the trucking industry as well as the drivers themselves, who have every means available to review and correct, if necessary, the information that is on file. DAC Services and the critical products developed in the early 1980s have played an important role in serving the trucking industry and maintaining highway safety for nearly 25 years."

USIS recommends that all truck drivers review the information contained in the DAC Employment History File just as they would information in their credit report. Truck drivers can do this by contacting USIS Commercial Services at 1-800-381-0645. There are established procedures for making corrections in a DAC Employment History File, which USIS uses to help drivers and comply with the Fair Credit Report act.

Originally filed in 2004 by seven individual truck drivers and OOIDA, the plaintiffs had requested class-action status for the case. Earlier this year the federal judge in this case denied the request for class-action status, and he later dismissed all four counts brought by two of the six truck driver plaintiffs as well as three of four counts brought by four remaining truck driver plaintiffs. The final count considered by the jury for the four remaining plaintiffs was whether, if alleged by the plaintiffs and OOIDA, USIS had failed to follow reasonable procedures to ensure maximum accuracy for collecting employment history information provided to USIS by trucking companies and used by trucking companies as one element of their company's hiring decision making process. The jury found in favor of USIS and no damages were awarded.
